1. Introduction
These Terms and Conditions (“Terms”) govern your use of the Zealandia Ceylon Language Academy website and all courses, coaching services and materials provided by us (“Services”). By accessing our website, contacting us or enrolling in any of our programs, you agree to be bound by these Terms in full.
Please read these Terms carefully before enrolling. If you do not agree with any part of these Terms, please do not use our Services.
2. About Us
Zealandia Ceylon Language Academy is a PTE Academic coaching institute operating in New Zealand and Australia, dedicated to helping students and skilled professionals achieve their target PTE scores for migration purposes.

3. Definitions
For the purpose of these Terms:
- “Academy” refers to Zealandia Ceylon Language Academy
- “Student” or “You” refers to any individual who enrols in or uses our Services
- “Course” refers to any PTE coaching program, class, mock exam or training session offered by the Academy
- “Materials” refers to all study resources, notes, recordings, mock exams and content provided as part of a course
- “Website” refers to the Zealandia Ceylon Language Academy official website
4. Enrolment and Registration
4.1 Eligibility You must be at least 16 years of age to enrol in any of our courses. By enrolling, you confirm that the information you provide is accurate, complete and up to date.
4.2 Enrolment Process Enrolment is confirmed only upon receipt of the required course fee payment and written confirmation from the Academy via email or WhatsApp. Submitting an enquiry or application form does not constitute a confirmed enrolment.
4.3 Accurate Information You are responsible for providing accurate personal details, including your current PTE score, target score, visa goals and contact information. Providing false or misleading information may result in cancellation of your enrolment without refund.
4.4 Account Responsibility If you are provided with login credentials for any online platform or learning management system, you are responsible for maintaining the confidentiality of those credentials. You must not share your access with any third party.
5. Course Fees and Payment
5.1 Fee Structure Course fees are as communicated to you at the time of enrolment. All fees are listed in New Zealand Dollars (NZD) unless otherwise stated. The Academy reserves the right to update course fees at any time. Any changes will not affect already confirmed enrolments.
5.2 Payment Terms Full payment or an agreed deposit must be made prior to commencement of classes unless a payment plan has been explicitly agreed upon in writing. The Academy reserves the right to withhold access to course materials until payment is received.
5.3 Payment Methods Accepted payment methods will be communicated to you at the time of enrolment. The Academy does not accept responsibility for any banking fees or currency conversion charges incurred by the student.
5.4 Late Payments If a payment instalment is not received by the agreed due date, the Academy reserves the right to suspend access to classes and materials until the outstanding amount is settled.
6. Refund and Cancellation Policy
6.1 Cancellation by the Student
- Cancellations made more than 7 days before the course commencement date are eligible for a full refund, less any administrative processing fee.
- Cancellations made between 3 and 7 days before the course commencement date are eligible for a 50% refund.
- Cancellations made less than 3 days before the course commencement date, or after the course has commenced, are not eligible for a refund.
- No refunds will be issued for missed classes, partial attendance or failure to engage with course materials.
6.2 Cancellation by the Academy If the Academy cancels a course or session for any reason within its control, students will be offered either a full refund or the option to transfer to an alternative session at no additional cost.
6.3 Force Majeure The Academy is not liable for cancellations or disruptions caused by circumstances beyond its reasonable control, including but not limited to natural disasters, government restrictions, pandemics, power outages or internet failures. In such cases, the Academy will make reasonable efforts to reschedule affected sessions.
6.4 Transfers Requests to transfer your enrolment to a different course intake must be made at least 5 days before your scheduled commencement date. Transfers are subject to availability and a one-time transfer fee may apply.
7. Attendance and Participation
7.1 Attendance Regular attendance is strongly encouraged as it directly impacts your progress and results. Students who miss more than 30% of scheduled sessions without prior notification may be removed from the program without refund.
7.2 Notifying Absences If you are unable to attend a scheduled class, please notify the Academy via WhatsApp or email at least 2 hours before the session. Repeated unnotified absences may affect your continued enrolment.
7.3 Make-Up Sessions Make-up sessions for missed classes are offered at the Academy’s discretion and subject to instructor availability. Make-up sessions are not guaranteed for every absence.
7.4 Online Classes For online sessions conducted via Zoom or any other platform, students are expected to join on time with a working camera and microphone. Technical issues on the student’s end do not entitle the student to a class replacement or refund.
8. Student Conduct
All students are expected to:
- Treat instructors, staff and fellow students with respect at all times
- Attend sessions on time and prepared
- Complete assigned practice tasks, mock exams and homework
- Refrain from disruptive, offensive or inappropriate behaviour during classes
- Not record, share or distribute any class sessions without prior written consent from the Academy
The Academy reserves the right to terminate a student’s enrolment without refund if their conduct is deemed disruptive, abusive or in violation of these Terms.
9. Course Materials and Intellectual Property
9.1 Ownership All course materials, including study guides, templates, practice exercises, mock exam papers, recorded sessions, and any other content provided by the Academy, are the intellectual property of Zealandia Ceylon Language Academy. All rights are reserved.
9.2 Permitted Use Materials are provided solely for the personal, non-commercial use of the enrolled student. You may not reproduce, distribute, sell, share, publish or transmit any course materials in any form without the prior written consent of the Academy.
9.3 Unauthorised Distribution Sharing or distributing course materials — including via WhatsApp groups, social media, email or any other channel — to non-enrolled individuals is strictly prohibited and may result in immediate termination of enrolment without refund, and may also result in legal action.
9.4 Recording of Sessions Students are not permitted to record any live coaching sessions without explicit written permission from the Academy. Any recordings made available by the Academy are for the personal use of the enrolled student only.
10. Results and Outcomes
10.1 No Guarantee of Results The Academy is committed to providing the highest quality coaching and support. However, we do not guarantee specific PTE scores, visa outcomes or migration results. Final exam performance depends on many factors including the student’s effort, practice, commitment and individual ability.
10.2 Visa and Migration Outcomes The Academy provides English language coaching only. We do not provide immigration advice, legal advice or visa processing services. Any information about visa score requirements is provided for general guidance only. Students are responsible for independently verifying current visa requirements with the relevant immigration authorities (Immigration New Zealand or the Department of Home Affairs, Australia).
10.3 Student Responsibility Achieving your target PTE score requires consistent effort, practice and engagement outside of class hours. The Academy’s role is to guide and coach — the student’s active participation is essential to success.
11. Rescheduling of Classes
11.1 By the Academy The Academy reserves the right to reschedule classes where necessary due to instructor unavailability, public holidays or unforeseen circumstances. Students will be notified as early as possible and a replacement session will be arranged.
11.2 By the Student Students may request to reschedule a 1:1 session by giving at least 24 hours notice. Rescheduling requests made with less than 24 hours notice may be treated as a missed session.
12. Online Platform and Technology
12.1 Student Responsibility For online classes, it is the student’s responsibility to ensure they have a stable internet connection, a functioning device, and access to the required platform (e.g. Zoom) prior to the scheduled session. The Academy is not responsible for technical difficulties on the student’s end.
12.2 Platform Changes The Academy reserves the right to change the online platform used for classes at any time. Students will be notified of any such changes in advance.
13. Privacy
Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use and protect your personal information.
14. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Academy’s total liability to you for any claim arising out of or related to these Terms or our Services shall not exceed the total amount of fees you have paid to the Academy in the 3 months preceding the claim.
- The Academy is not liable for any indirect, incidental, consequential or punitive damages, including loss of income, visa rejection, loss of opportunity or any other losses arising from your use of our Services.
- The Academy is not responsible for any third-party services, platforms or tools used in connection with the delivery of our courses.
15. Indemnification
You agree to indemnify, defend and hold harmless Zealandia Ceylon Language Academy, its instructors, staff and representatives from any claims, liabilities, damages, losses or expenses (including legal fees) arising from your violation of these Terms, your misuse of our Services, or your infringement of any third-party rights.
16. Testimonials and Marketing
By submitting a testimonial, review or success story to the Academy, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish that content for marketing and promotional purposes, including on our website and social media channels. You will always be credited appropriately unless you request anonymity.
If you do not wish your testimonial to be used for marketing purposes, please notify us in writing at the time of submission.
17. Changes to These Terms
The Academy reserves the right to update or modify these Terms at any time. The most current version will always be available on our website, with the “Last Updated” date revised accordingly. Continued use of our Services following any changes constitutes your acceptance of the revised Terms.
For significant changes, we will endeavour to notify enrolled students directly via email or WhatsApp.
18. Governing Law and Dispute Resolution
18.1 Governing Law These Terms shall be governed by and construed in accordance with the laws of New Zealand. Where a student is based in Australia, Australian consumer protection laws may also apply.
18.2 Dispute Resolution In the event of a dispute, both parties agree to first attempt to resolve the matter through good faith discussion. If a resolution cannot be reached informally, the dispute shall be referred to mediation before any legal proceedings are initiated.
18.3 Consumer Rights Nothing in these Terms limits or excludes any rights you may have under the Consumer Guarantees Act 1993 (New Zealand) or the Australian Consumer Law, where applicable.
19. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable for any reason, that provision shall be deemed severable from the remaining Terms and shall not affect the validity or enforceability of the remaining provisions.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zealandia Ceylon Language Academy with respect to your use of our Services and supersede all prior communications, representations or agreements, whether written or oral.

These Terms & Conditions are effective as of January 2025 and apply to all students enrolled with Zealandia Ceylon Language Academy from that date.
